General conditions of use for services offered by the site

The internet site www.abo.net (herein the " Web site") owned by Eni S.p.A whose corporate headquarters are in Piazza Enrico Mattei 1, Rome (herein "Eni S.p.A.'' or "Eni") contains online services and information offered by Eni (herein the “Services”). Use is subordinate to the acceptance by those who access the site (herein the “User”) of the conditions outlined below. Eni may at any time modify these conditions and any such changes will have immediate effect without the necessity of approval by users. As such, the user expressly authorises Eni to advise by email any eventual changes to the conditions. It remains the responsibility of the user to maintain a record of the conditions and any subsequent modifications. In any case, the use of even a single service by the user constitutes tacit acceptance of the general conditions, eventual modifications and/or particular conditions indicated.

1. Provision of Services

In the expectation of free access to the Services provided by Eni, the user accepts the following:

  • a) Eni S.p.A. may at any time suspend or definitively interrupt the provision of Services, in part or in total;
  • b) use of Services is made at the user’s own risk;
  • c) the Services are provided free of charge, in the form in which they appear and without the promise or guarantee
  • of validity or accuracy of content, utility or continuity of service;
  • d) Eni S.p.A. offers no guarantee for the results expected from use of Services;
  • e) given that Services may not be supported by all commercially available browsers and/or operating systems or different versions of the same, it is the responsibility of the user to ensure the appropriate combination of software and hardware for adequate use of the Services.

2. Access to Services

In order to access the Services users are required to register using the form provided and which appears on the home page. Eni S.p.A. asks users to provide some personal details, the treatment of which will be conducted in line with the notice, available on the site, in conformity with legislative decree 196/2003 (the Italian personal data protection code).
On registration, using the email address provided by the user among his/her personal details, a message will be sent reproducing these conditions and the privacy notice, including a request to confirm the accuracy of the data provided and acceptance of the aforementioned conditions and consent for the utilisation, within the terms of current legislation, of the user’s personal details. Such confirmation, provided by the user, will serve as authentication in the form of an electronic signature, as per Art. 6 of legislative decree dated 23 January 2002 n. 10. With acceptance of the general conditions, the user declares that his/her personal details are true, correct and up to date. The user also agrees to promptly inform Eni of and changes to such data in order that they may be kept up to date, complete and true. The user’s password and username are personal and may not be ceded to others. Users are responsible to ensure that usernames and passwords remain secret.

3. Intellectual and industrial property rights with regard to the web site and Services

All intellectual property rights concerning data, information regarding Services, including, for example, know how, 9source codes, software, hardware, applications, algorithms, models, data bases and similar, coming from Eni and made available to the user, belong exclusively to Eni . The user expressly recognises that he/she has no rights, with the exception of the exclusively personal use as indicated above. The data bases on which the Services are based (herein the ‘data bases’) as well as the content of the web site are protected by copyright as per Law N°633 of 22 April 1941 and subsequent modifications (herein ‘copyright law’). In line with this protection, the only use permitted of data bases by the user is that made in conformity with the present conditions. All rights are reserved and content may not, either in total or in part, be copied, reproduced, transferred, published or distributed in any form without the prior consent of Eni.

4. Prohibition of the resale or commercial use of the Services

5. Links

Eni accepts no responsibility for informative content and material realised or published by third parties in any form, and with regard to which the web site includes imbedded links. Users who decide to connect to links included on the web site do so at their own risk. Users also have the personal responsibility to protect themselves against the eventual presence of viruses or similar elements that may damage or destroy the content of those who access sites through links on the web site. Connection via such links with other sites does not imply in any way that Eni has relations of sponsorship and/or cooperation and/or affiliation with the owners and/or managers of such sites.

6. Limits of responsibility and absence of guarantees

With regard to the provision of Services free of charge, Eni shall not be responsible for any damage, direct or indirect, deriving from the wrong and/or defective operation of electronic equipment, or deriving from the use of information contained on the web site. All the information contained on the web site may, without warning, be modified or updated at any time. Certain sections of the web site may be modified or cancelled at any time and without warning, Eni makes no claims and provides no guarantee about the use of the contents of the web site in terms of correctness, accuracy, adequacy, usefulness, promptness, reliability or other.

7. Appropriate use and waiver

The user agrees to use the Services exclusively for legitimate purposes and in line with the rules of netiquette issued by the competent Naming Authority. It remains clear that users make use of the Services at their own risk and are fully responsible for the content of messages and texts sent by him/her and exonerates Eni from any eventual consequences deriving from the negligent conduct of the user in accessing the Services. Any information and/or material supplied to Eni by any user of the eni.it site through the site itself will not be considered of a private and confidential nature. Consequently Eni has no obligation with regard to such information and/or material and Eni reserves the right to use any information acquired through its site in any way it deems appropriate.

8. Legislation and competent court

These conditions relating to access to the web site are regulated by Italian law and the competent court is that of Rome, that will have complete jurisdiction for any eventual controversies arising from or connected with these conditions. Despite this, Eni reserves the right, should it be deemed necessary, to pursue legal action also in courts outside of Italy or in other cities of Italy other than Rome, in order to protect its interests and ensure the respect of its rights.

9. NewsNow Service

The selection of the contents in the sections International News and Weblog shall be under the exclusive responsibility of the provider of the service.
